BE STEM READY – Terms and Conditions

1. Introduction

Welcome to BE STEM READY! These Terms and Conditions (“Terms”) govern your access to and use of our website (“Website”), STEM education services, including educational programs and trainer training (“Services”), and the purchase of robotics kits and competition kits (“Products”). By accessing or using our Website, Services, or Products, you (“you” or “your”) agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Website, Services, or Products.

2. Use of Services and Products

  • Age Restrictions: Our Services and Products are intended for users of all ages. However, if you are under the age of 13, you must obtain verifiable consent from your parent or legal guardian to use our Website and Services. During registration, you may be required to provide your age and parental/guardian contact information.
  • Permitted Use: You may use our Services and Products for personal, non-commercial, and educational purposes only. You may not reproduce, distribute, modify, or create derivative works of our educational materials, course content, or software without our prior written consent.
  • Product Use and Safety: You are responsible for the safe and proper use of our Products (robotics or drone kits, competition kits). Please carefully follow all provided instructions and safety guidelines. BE STEM READY is not liable for any injuries or damages resulting from the misuse of our Products. We recommend adult supervision for younger users.
  • Software/Platforms: If our Services involve the use of specific software or online platforms, you agree to comply with the terms and conditions of those platforms. Links to these third-party terms will be provided where applicable.
  • Website Availability: We strive to maintain continuous access to our Website. However, we do not guarantee uninterrupted availability. The Website may be temporarily unavailable for maintenance, updates, or other reasons. We are not liable for any damages or losses resulting from website downtime.

3. Registration and Account

  • To access certain features of the Website or Services, you may need to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.   
  • You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.   
  • We reserve the right to suspend or terminate your account at our discretion, for any reason, including but not limited to a breach of these Terms. Examples of breaches include, but are not limited to, sharing account credentials, or engaging in disruptive behavior on our platforms.   

4. Payment and Fees

  • Fees for our Services and Products are displayed on the Website. All fees are in Malaysian Ringgit (MYR) and are exclusive of any applicable taxes (SST), which is the Malaysian Sales and Service Tax.
  • We accept the following payment methods:
    • Online Bank Transfer
    • Walk-in Cash/Credit Card/Debit Card
  • Payment is due upon order confirmation.
  • Refund Policy:
    • Services (STEM education programs, trainer training): All sales for our Services are final. Due to the immediate allocation of resources, including curriculum development, instructor time, and facility rental, we are unable to provide refunds.
    • Products (Robotics Kits, Competition Kits): Our refund policy for physical Products is separate from our Services.
    • Limited Exceptions (Products Only): While all sales for Services are final, we may consider refunds for Products in extremely limited and exceptional circumstances, such as if the product is demonstrably defective upon arrival. Such requests will be evaluated on a case-by-case basis at the sole discretion of BE STEM READY. If you believe your situation warrants consideration for a Product refund, please contact us at contact@bestemready.com within 3 days of receiving the product, explaining the defect in detail and providing supporting evidence (e.g., photos, videos). Contacting us does not guarantee a refund.

5. Intellectual Property

  • All content on the Website, including but not limited to text, graphics, logos, trademarks, and software, is the property of BE STEM READY and is protected by copyright and other intellectual property laws.

6. Limitation of Liability

  • To the maximum extent permitted by law, BE STEM READY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website, Services, or Products.   

7. Disclaimer of Warranties

  • We provide our Services and Products “as is” without any warranties of any kind, either express or implied. We do not warrant that our Services or Products will be uninterrupted, error-free, or meet your specific requirements.

8. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Malaysia.   
  • Any disputes arising out of or related to these Terms shall be resolved through mediation in Subang Jaya, Selangor. If mediation is unsuccessful, disputes shall be resolved in the courts of Malaysia.   

9. Modifications to Terms

  • We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Website. Your continued use of the Website or Services after the posting of the updated Terms constitutes your acceptance of the changes.   

10. Privacy Policy

  • Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

11. Force Majeure

  • BE STEM READY shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, strikes, or government actions.
